Usage

The Interocitor is an internet presence provider. We host web pages and provide email services. The Interocitor has certain legal and ethical responsibilities regarding the use of its computer network and equipment involved in these services.

It is our goal to be unbiased in providing hosting services for the World Wide Web. However, we reserve the right to cancel or interrupt any client's access to our services if we believe the account is abused.

Unacceptable Use Policies

Unsolicited Bulk E-Mail (UBE)

Any Unsolicited Bulk E-mail (UBE) is considered "spamming" and may result in your account suspension or cancellation. Spamming or UBE is frowned upon in the industry and in most cases is considered "unethical". Additionally, it creates undue strain on our equipment resources. E-mail is meant to be person-to-person or one party to an agreeable second party.

Traffic And Storage

We currently offer two types of accounts: Commercial and NumanFan. You are free to store any type of content on our servers if you are a Commercial customer, providing it does not violate any other provision in these Terms. NumanFan customers are limited to storing files about or concerning Gary Numan, fans of Gary Numan (including yourself), or the music industry as it pertains to Gary Numan. In short, your site must be a Numan site. The Interocitor and its officers will be the sole judge of what is and what is not Numan related. However, we realize that any two reasonable people may differ in their opinion of what is or is not Numan-related, so please look further down at the Cancellation section for more on how such differences may be addressed.

Each website customer pays for, and is allotted, a specific amount of disk space for their exclusive use. To ensure that the rights of other customers aren't trampled upon, we reserve the right to enforce disk quota limits. See the Cancellation section for more specific information.

No specific limits are imposed upon the customer in regards to total bandwidth consumed. However, if you have built a website that becomes extremely popular, this may impede the ability to view other sites on this service. Therefore, we reserve the right to impose reasonable bandwidth "throttling" limits on any site that is deemed to be consuming an undue share of the available bandwidth. If the bandwidth demands are later reduced, we will remove the "throttling".

Adult & Non Acceptable Material

No pornography, unethical, or other "adult" related material of any kind is to be stored on our servers. We reserve the right to determine what is or is not "ethical" in any matter. Our intention is to allow the customer the maximum freedom possible, but to disallow any activity that would put the customer and/or The Interocitor in violation of the Criminal Code of Canada. Further, it is our intention to be as flexible as legally possible - in the event a problem with your site arises and we contact you, please bear this in mind: we will likely make suggestions as to what you can do to make your site comply with the law with a minimum of alteration.

Payment

Pre-payment is required on all accounts, usually on an annual basis. All fees are guaranteed for the payment period once received. Payment must be made by cheque, money order, wire transfer, or cash (note: sending cash by mail is not recommended). Returned cheques will be assessed a $20 service charge. All accounts are paid in Canadian dollars - however, payment in US dollars will be accepted if a 3% currency conversion fee is included.

Cancellation

Cancellation may occur at any time and be invoked by the customer or The Interocitor. We reserve the right to cancel hosting services at any time. Any cancellation by the customer must be in writing and sent via snail mail (for security reasons - we don't want any mischievous people out there cancelling your service without your permission). The Interocitor will notify the customer of cancellation only via e-mail. If your account is cancelled by The Interocitor, and not for reasons of abuse of policy, then the remaining pro-rated portion of your account time will be refunded. If you cancel the account, the remaining pro-rated portion of your account time, less 30 days, will be refunded.

We will not cancel your account for violation of this policy without first making all reasonable efforts to work with you towards the goal of making your site compliant with this policy. NumanFan account customers take special note here: we will be somewhat flexible in what is a "Gary Numan Site", but we won't allow you to walk all over us. You're getting a very good deal for one reason: we wish to promote Gary Numan sites. If you don't abuse this, then you'll have no problems. This means that, yes, you can also use the site for things like a "personal page", "other interests that I have", and that sort of thing. But don't use 3 megabytes for your Numan site and 97 megabytes for your multilevel marketing site. If in doubt, ask.

If your account exceeds your allotted disk space, you will get at least one warning, and a reasonable amount of time to correct the situation. We reserve the right to cancel the account of anyone who consistently abuses the disk space quota, but our policy is to first send a warning and, if the warning is not heeded, simply delete some of your files until your site goes under the quota.

Legalese

The Interocitor requires all use by customers be for a lawful purpose only, as defined by the Criminal Code of Canada. We reserve the right to refuse service at any time to anyone for any reason. Use of The Interocitor's servers or bandwidth in violation of any Federal, Provincial or Municipal by-law, law, or regulation is prohibited and constitutes grounds for cancellation without refund. Any violation of the above will result in a warning of violation. If the violation is not ceased immediately, the lack of action will be grounds for termination of your account.

The Interocitor's services are intended for the end user only. Customers cannot sublease, subhost, or give away control of any portion of The Interocitor's resources. Doing so could result in immediate account cancellation.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold The Interocitor harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney fees asserted against Interocitor Web Creations, its agents, its customers, officers and employees, that may arise or result from any service provided or performed, or agreed to be performed or any product sold by Customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless The Interocitor against liabilities arising out of: (1) any injury to person or property caused by any products sold or otherwise distributed in connection with The Interocitor's servers; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from The Interocitor's server.

Disclaimer

The Interocitor will not be responsible for any damages your business may suffer. The Interocitor makes no warranties of any kind, expressed or implied for services we provide. The Interocitor disclaims any warranty or merchantibility or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by The Interocitor and its employees. The Interocitor reserves the right to revise its policies at any time.

The Interocitor is an internet presence provider. We provide space on our servers to our customers but are not responsible for the content. We will not undertake to screen any of the content uploaded to our servers. If a complaint is received about the content of any member site, we will investigate. If the site is deemed to be in violation of these Terms, appropriate action will be taken.
